Official Rules and Regulations

ARTICLE I — SWEEPSTAKES PERIODS

1.1 Sweepstakes Year. The Sweepstakes runs annually, commencing January 1 and concluding December 31 of each calendar year (the “Sweepstakes Year”).

1.2 Prize Periods. Each Sweepstakes Year consists of two (2) Prize Periods, as follows:

1.3 Awarding of Prizes. At the conclusion of each Prize Period, one (1) prize will be awarded to an eligible winner pursuant to the provisions herein.

ARTICLE II — PRIZES

2.1 Prize Description. Each winner will receive up to $10,000 in bath remodeling products, provided by Smart Choice Baths, inclusive of installation, at approximate retail value. The prize package will include:

Shower base or bathtub
3 Shower walls
Two (2) corner shelves
Standard showerhead and diverter

2.2 Upgrades & Additional Costs. Any upgrades or additional options not specifically listed above, including but not limited to luxury fixtures, upgraded showerheads, tile patterns, or custom features, will be the sole responsibility of the winner and may incur additional charges. These upgrades are not included in the prize package and will be borne by the winner.

2.3 No Cash Redemption. Unused prize allowance cannot be redeemed for cash and will be forfeited.

2.4 Substitution of Prizes. Smart Choice Baths reserves the right to substitute a prize of equal or greater value at its sole discretion if the originally advertised prize is unavailable.

2.5 Odds of Winning. The odds are determined by the total number of eligible entries received during the applicable Prize Period.

ARTICLE III — ELIGIBILITY

3.1 Geographic Limitations. Sweepstakes open only to legal residents of Ohio residing in the following counties:

Lorain, Cuyahoga, Medina, Summit, Stark, Lake, Geauga, Portage, Wayne, Ashland, Richland, Huron, Trumbull, Ashtabula.

3.2 Age and Property Ownership. Participants must:

Be 18 years of age or older;
Own a single-family home located within the specified service area;
Ensure the home meets the installation criteria described in Section 6.2.

3.3 Exclusion of Certain Persons. Employees, officers, directors, and agents of Smart Choice Baths, its affiliates, subsidiaries, advertising, marketing, promotion, or fulfillment agencies, and immediate family members or persons residing in the same household are ineligible.

ARTICLE IV — ENTRY METHODS

4.1 General Limitation. One (1) entry per participant per calendar year, except where bonus entries apply under Section 4.4.

4.2 Online Form Submission (Free Entry). Participants may complete the official sweepstakes form at: www.SmartChoiceBaths.com/bathroom-sweepstakes.

4.3 Phone Entry (Free Entry):
Call us at 1 (844) 438-7627 to provide your required information for entry.

4.4 Social Media Entry (Free). Participants may follow both Instagram and Facebook pages @SmartChoiceBaths and tag ten (10) friends or family members in the comments under the most recent sweepstakes post.

4.5 Bonus Entries for Purchase. Participants who purchase a bathroom remodeling project during a Prize Period automatically receive ten (10) additional entries for that Prize Period’s drawing.

4.6 Mail-In Entry Alternative. Participants may submit a 3″x5″ card with their full name and mailing address, marked “Smart Choice Baths $10,000 Sweepstakes,” to:

Mailed entries must be postmarked no later than 5 business days prior to the end of the applicable Prize Period.

ARTICLE V — WINNER SELECTION AND NOTIFICATION

5.1 Random Selection. Winners will be selected at random from all eligible entries within five (5) business days following the close of the Prize Period.

5.2 Recording of Selection. The random drawing will be recorded on video. Recordings may be posted on Smart Choice Baths’ website and social media platforms in conjunction with the winner announcement.

5.3 Notification. Smart Choice Baths will attempt to notify winners via phone or email within 10 business days of selection.

5.4 Failure to Respond. If a winner cannot be contacted, fails to respond, or is otherwise ineligible, Smart Choice Baths will select an alternate winner using the same random process.

5.5 Winner Verification. All winners must execute an Affidavit of Eligibility, Liability Release, and Publicity Release prior to receiving the prize.

ARTICLE VI — INSTALLATION OF PRIZE

6.1 Scheduling. Winners must schedule installation within one (1) month of award notification, with completion within six (6) months.

6.2 Installation Criteria. Homes must be:

Structurally sound and free of water, mold, or other conditions that could interfere with safe installation;
Equipped with adequate electrical, plumbing, and space to accommodate the remodeling products;
Compliant with applicable local building codes.

6.3 Winner Responsibilities. Any repairs, modifications, or remediation necessary to meet installation criteria are the sole responsibility of the winner.

6.4 Installation Exclusions. Installation does not include painting, flooring, lighting, or HVAC systems, unless explicitly stated.

ARTICLE VII — PRIVACY AND DATA HANDLING

7.1 Collection and Use. Personal information is collected solely for Sweepstakes administration and will not be shared or sold to any third party.

7.2 Retention. Participant data will be retained for 24 months from the date of entry.

7.3 Promotional Use. Acceptance of a prize constitutes consent for Smart Choice Baths to use winner’s name, likeness, images, and testimonial for promotional purposes.

ARTICLE VIII — LIMITATIONS AND RIGHTS

8.1 Disqualification. Smart Choice Baths reserves the right to disqualify any entry deemed incomplete, illegible, late, or in violation of these rules.

8.2 Suspension or Termination. Smart Choice Baths may suspend, modify, or terminate the Sweepstakes at its discretion; prizes awarded prior to such action will be honored.

8.3 Tampering. Any participant attempting to tamper with the Sweepstakes will be ineligible and may be prosecuted to the full extent of the law.

ARTICLE IX — ARBITRATION AND WAIVER

9.1 Binding Arbitration. All disputes arising from or relating to the Sweepstakes shall be resolved individually through binding arbitration under American Arbitration Association rules, conducted in Cuyahoga County, Ohio.

9.2 Class Action Waiver. Participants waive the right to participate in a class action or any representative action.

9.3 Governing Law. The Federal Arbitration Act governs all proceedings under this Section.
